A 24-year-old Kent man faces charges of third-degree assault and first-degree attempted animal cruelty after he allegedly threw his dog down a storm drain as well as head-butted and bit a Kent Police officer as he attempted to arrest him.

Kyle E. Macey is scheduled to be arraigned on the charges Monday, July 11 in King County Superior Court at the Norm Maleng Regional Justice Center. Macey remained in custody Thursday at the Regional Justice Center county jail with bail set at $55,000.

The incident started at about 3:43 a.m. June 25 at a home in the 9400 block of South 248th Street when police were dispatched to a report of a man using his fists to break his mother’s car window, according to charging papers.

The mother told dispatch her boyfriend had showed up at the house and the two were leaving because Macey yelled at them and then broke her car window.

Macey then reportedly grabbed his dog and carried it to a storm drain across the street where he pulled off an approximately 100-pound grate cover and threw the pit bull down an approximately 8-foot deep storm drain. He also threw the grate cover down the hole. He then picked up several boulders weighing about 20 pounds each and dropped them down the drain one at a time.

Witnesses told officers that Macey claimed he was sacrificing his dog, according to charging papers. King County animal control officers later recovered the dog and transported it to a veterinary hospital. The dog’s condition is not known.

When police arrived, they saw Macey run across South 248th Street to a church and hide in the bushes. They found him shirtless, crouching down and shining a flashlight at officers. He had bloody knuckles and rambled about God.

Three officers took Macey into custody and handcuffed him. When officers tried to place Macey into a patrol car, he reportedly resisted. Officers used strikes to his body as well as a Taser but all were ineffective.

Macey then head-butted one of the officers on the forehead. As another officer placed his left arm around Macey’s neck, the man bit the officer’s bicep, causing the skin to tear and blood to flow down his arm. Teeth marks were visible and the arm quickly bruised. The officer was taken to Auburn Regional Hospital for treatment.

Several more officers were called to the scene. They eventually leg shackled Macey and put a spit hood over his head and placed him in a jail van. Macey also told police he had recently smoked marijuana dipped in sherm. Some people dip marijuana cigarettes in embalming fluid (or sherm) for a hallucinogenic feeling.

According to court documents, Macey has a long criminal history that includes third-degree assault of a police officer in 2009; fourth-degree assault in 2009; driving while license suspended in 2007; marijuana possession in 2007; as well as juvenile convictions for second-degree malicious mischief in 2003 and 2004; taking a vehicle without permission in 2004; third-degree theft in 2003; trafficking in stolen property in 2002; third-degree assault in 2002; harassment in 2002; and resisting arrest in 2002.

Macey also has a pending fourth-degree assault charge from April in Kent.
